NOTWITHSTANDING ANY PROVISION IN THESE TERMS, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CAUSE OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA INN IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
9. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Inn, its parent companies, subsidiaries, affiliates, officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service;
- Your use of the Site or services in a manner not authorized by these Terms;
- Your violation of any third-party rights, including intellectual property rights or privacy rights;
- Your violation of any applicable federal, state, or local law or regulation;

13. Dispute Resolution and Arbitration

THE ARBITRATION SHALL BE CONDUCTED IN THE ENGLISH LANGUAGE. JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT OF COMPETENT JURISDICTION.
The arbitrator shall have authority to award the same damages and relief as a court of competent jurisdiction, including injunctive and declaratory relief, provided that the arbitrator may not award relief that exceeds what the applicable law allows.
13.3 Class Action Waiver
YOU AND PIZZA INN AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND PIZZA INN AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.
13.4 Exceptions
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction in order to prevent irreparable harm pending the outcome of arbitration, including but not limited to matters involving intellectual property infringement or unauthorized access to the Site.
14. Term and Termination
These Terms shall remain in full force and effect for as long as you access or use the Site or any of our services. Pizza Inn reserves the right, in its sole discretion and without prior notice, to:
